The website www.theevolynx.com (“website” or “site“) is the official website of evolynx s.r.o. (“evolynx”, “company”, “we”, and “our”), a limited liability company with its registered office at Jandova 598/1, 190 00 Prague, Czech Republic, company ID No. 063 99 819, registered in the Companies Register maintained by the Municipal Court in Prague, file C 281512.
 
Your privacy is our concern, and we are serious about it. This privacy and cookie policy (“policy”) was last updated in March 2018 and describes how evolynx collects, uses, shares and protects personal data of users of our website, products and services (referred to collectively as the "services"). The policy also sets how you can contact us if you have any queries or concerns regarding your personal data.

We reserve the right to modify the policy at any time, so we encourage you to review it frequently. If we make any material change to the policy, we will post a notice on our site prior to such change taking effect. 1. Data we collect

evolynx may collect information about you in several different ways, including personal data. As used in this policy, “personal data” means any information which, either alone or in combination with other information we hold about you, identifies you as an individual. This includes, for example, your name, postal address, email address and telephone number.

Please take care when submitting information to us: the process of data collection may be automated and we may not recognize that you have provided us with incorrect, incomplete or sensitive data. If you do not consent to our processing and use of sensitive personal data (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership), you must not submit such user generated content to our site or not disclose it otherwise to us.

We collect information about you in the following ways:

  • Information you provide us with, including:

    • the personal data you provide us with when you use our website, including your‎ name, postal address, email address, telephone number, username, password and demographic information;

    • the personal data you provide us with when you report a problem with our website or when we provide you with customer support;

    • the personal data you provide us with  when you correspond with us by phone, email or otherwise.

  • Information from Social Networking Websites ("SNW"). Our website includes interfaces that allow you to connect with SNW. If you connect to a SNW through our website, you authorise us to access, use and store the information that you agreed the SNW could provide us with based on your settings on that SNW. We will access, use and store that information in accordance with this policy. You can revoke our access to such information at any time by amending the appropriate settings from within your account settings on the applicable SNW.

  • Information we get from others. We may also get information about you from other sources, such as any third party that you have chosen to make accessible to general public or anywhere else on the internet. We may add this to information we get from our website.

  • Information Automatically Collected. For purposes of analysis and improvement of our services, we automatically log information about you and your computer or mobile device when you access our website, including: IP address, browser type and language, date and time of your request, pages visited and time spent on a page, device OS name and version, manufacturer and model. We collect this information about you using cookies (please refer to the related section. 

 
2. How we use the data we collect

We may use your personal data for the following purposes:

  • to provide services to you;

  • for verification purposes;

  • to provide a better user experience (including services that display customized content or advertising of our services) and more seamless customer support;

  • to operate, maintain, improve and enhance our website and our existing products and services, as well as to develop new offerings;

  • for marketing and sales purposes (see section 5, below);

  • for the purposes of product and market statistics, research and analytics, benchmarks and other analyses (see section anonymous statistic, below).

3. Sharing your personal data for legal and business purposes

Data is never sold or given out to a third party that has no legitimate reason for acquiring it. We may share your personal data as follows:

  • Third parties designated by you. We may share your personal data with third parties where you have provided your consent to do so.

  • Our third party service providers. We may share your personal data with our third party service providers who provide services such as data analysis, payment processing, information technology and related infrastructure provision, customer service, email delivery, auditing and other similar services. These third parties are only permitted to use your personal data to the extent necessary to enable them to provide their services to us. They are required to follow our express instructions and to comply with appropriate security measures to protect your personal data.

  • Third party advertisers. We may share personal data with advertisers and advertising networks that require the data to select and serve relevant adverts to you and others.

  • Corporate restructuring. We may share personal data when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.

  • Affiliates. Personal data might be revealed to evolynx’s affiliates, to the extent of their justified need for knowing the said personal data, arising out of the business relationships between the user, evolynx and its affiliate in which case we will require our affiliates to comply with this policy.

  • Other disclosures. Personal data might be shared as we believe necessary or appropriate to: (a) a public entity legitimately demanding to audit it (such as the tax board); (b) comply with applicable laws; (c) enforce our policy; (d) protect our rights, privacy, safety or property, and/or that of you or others.

Data will be shared provided that, in all such circumstances, we will only share the limited personal information that is required to be shared in the unique situation.

In case applicable law requires a specific legal mechanism to transfer such data, we will always ensure that such legal mechanism is implemented (see section 6 for further details).

 
4. Anonymous statistics

We may use aggregated anonymised data derived from the personal data provided by you or collected by the program analytics for a number of purposes as outlined above. We may use such data in particular for our own statistics, for auditing, for the purposes of product and market research, for analytics (which helps us improve and develop our products and services), and for benchmarks and other analyses. Additionally, we may choose to publish such anonymised data and to share it with third parties outside of evolynx. We will not directly or indirectly transfer any data received from you to (or use such data in connection with) any ad network, ad exchange, data broker, or other advertising or monetization related toolset.

 
5. Marketing communications

We may send you various newsletters or communications which may include, for instance, details about our services and products, including newsletters containing special offers in which you may be interested. We may also send you invitation to events that we organize.  For these purposes, we may share your contact details with our vendors or business partners who provide services or functions on our behalf, including event organization, marketing, distribution of surveys or sweepstakes programs, payment processing, customer service, or public relations.  These third-party vendors have access to and may collect information only as needed to perform their functions on our behalf and are not permitted to share or use the information for any other purpose.

Your marketing communication preferences may be changed at any time by following the instructions below:

  • if you would like to unsubscribe from an email sent to you, follow the ‘unsubscribe’ link and/or instructions placed at the bottom of the email, where present;

  • alternatively, please contact us using the details in the “Contact us” section below to change your marketing communication preferences.

Please note that we may occasionally send you important information (including via email) about our services that you are using or have used including changes to applicable terms and conditions and/or other communications or notifications as may be required to fulfill our legal and contractual obligations.

These important service communications are not affected by your marketing communication preferences.

 
6. Security and location of your data

We seek to use reasonable organizational, technical and administrative measures in order to protect your data against accidental loss, destruction, alteration, unauthorized disclosure or access or unlawful destruction. Such measures may include, without limitation, taking reasonable steps to ensure the reliability of employees having access to your data and providing for limited access rights and access controls; authentication; personnel training; regular back up; data recovery and incident management procedures; restrictions on storing, printing and disposal of personal data; software protection of devices on which personal data are stored; etc.

Data collected from you may be transferred to, stored at and processed by us and our affiliates and other third parties outside the country in which you reside, including, but not limited to the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. By using this site, you agree to this transfer, storing or processing. While we reserve the right to change our business partners and /or data locations, we will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

Unfortunately, neither any storage system, nor transmission of information via the internet can be guaranteed to be completely secure. How to control cookies

If you do this, however, you may have to manually adjust some preferences every time you visit a site and some services and functionalities may not work.

 
8. Pixel tags

We may also use pixel tags (which are also known as web beacons and clear GIFs) to track the actions of users on our website. Unlike cookies, which are stored on the hard drive of your computer or mobile device by a website, pixel tags are embedded invisibly on web-pages. Pixel tags measure the success of our marketing campaigns and compile statistics about usage of the website, so that we can manage our content more effectively. The information we collect using pixel tags is not linked to our users’ personal data.

 
9. Access to your data and your rights

If your data is incorrect or if you believe that our processing of your personal data is in contradiction with the protection of your private and personal life or in contradiction with the law, you have the right to access and correct your personal data, to request blocking, correction, supplementing, or liquidation of your personal data; further, you have the right to appeal directly to the relevant Data Protection Authority.

You can at any time request information about the processing of your personal data, and we will provide such information to you free of charge. For your protection, we may only implement requests with respect to the personal data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.

In addition, you may revoke your consent allowing evolynx to process your personal data at any time; however, in such case, we may no longer be able to offer you our services.

Our website may contain links to third party sites and features. This policy does not cover the privacy practices of such third parties. These third parties have their own privacy policies and we do not accept any responsibility or liability for their websites, features or policies. Please read their privacy policies before you submit any data to them.
